DTLA DOG WALKING CLUB WAIVER

Please Read Carefully Before Participating

This waiver and release agreement ("Agreement") is between you and Fitpals Dog Training ("Fitpals").

1. Participation and Release:

• You acknowledge that you cannot participate in any Fitpals class, service, event, or activity (collectively, "Activity") without agreeing to this Agreement.
• By submitting an RSVP or attending an Activity, you agree to and accept this Agreement.

2. Risk Assumption and Release:

• You understand that Fitpals is not responsible for your personal belongings during an Activity.
• You understand that Activities can be physically demanding and involve inherent risks of injury, disability, property loss, illness (including COVID-19), and death.
• You assume all risks associated with your participation, including discomfort, muscle soreness, and, rarely, cardiovascular problems or death.
• This risk assumption includes the use of equipment, props, or sidewalks.

3. Animal Responsibility:

• You assume full responsibility for the actions of any animal you bring to an Activity.
• You confirm that your pet(s) are licensed in accordance with local laws.
• You acknowledge the inherent risks involved with animals and that any animal can bite, regardless of training.

4. Indemnification and Hold Harmless:

• You agree to indemnify, hold harmless, and defend Fitpals from any claims, demands, or liabilities arising from your participation in an Activity, even if caused by the negligence of Fitpals, its agents, employees, or contractors.
• This includes, but is not limited to, injuries resulting from equipment malfunction, improper maintenance, negligent instruction, or slips and falls.

5. Supervision:

• You understand that Fitpals staff is not responsible for supervising your pet.

6. Acknowledgement and Understanding:

• You acknowledge reading and understanding this Agreement.
• You understand that any future risk advisories will be incorporated into this Agreement.

7. Disclaimer:

• Fitpals is not responsible for unintentional errors, omissions, or incorrect information.
• Recommendations for products or services do not guarantee your satisfaction.

8. Photo and Video Release:

• You grant Fitpals permission to use your likeness, photos, and videos from Activities for promotional or informational purposes.
• You understand you will not receive compensation for this use.
• You release Fitpals from any liability related to the taking, processing, or publication of this media.

9. Entire Agreement and Severability:

• This Agreement constitutes the entire agreement between you and Fitpals.
• If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

10. Binding Agreement:

• You represent that you are over 18 and legally competent to enter this Agreement.
• This Agreement is binding upon your RSVP, attendance at an Activity, or signature.

BY PARTICIPATING IN THE DTLA DOG WALKING CLUB, YOU AGREE TO THE TERMS OF THIS AGREEMENT.
